Privacy Notice for Aerodyne Flight Institute

1.0 INTRODUCTION

Aerodyne Geospatial Sdn. Bhd. [(201201028098) (1012585-K)] and Aerodyne Group of Companies, including Aerodyne Ventures Sdn. Bhd. [201801002751) (1264764-P)] (“Aerodyne Group”) and its subsidiaries, associated companies, affiliates, successors, assigns, and licensees (each, the “Company” and collectively, “AERODYNE”) are committed to complying with the Personal Data Protection Act 2010 (“PDPA”). In this Personal Data Protection Notice (“Privacy Notice”), “we”, “us” and “our” refers to AERODYNE, and “you”” and “your” or any derivation thereof, as used herein refers to the individual who is the subject of the Personal Data

The Bahasa Malaysia version of this Privacy Notice is appended in Appendix A. In the event of any conflict between the English and other language of this Privacy Notice, the English version shall prevail.

AERODYNE shall have the right to modify, update or amend the terms of this Privacy Notice at any time by circulating an updated version of this Privacy Notice by e-mail or such other manner of notification as AERODYNE deems fit, and you shall be deemed to have agreed to and accepted such modifications, updates or amendments following such notification.

2.0 CONSENT

Although provision of Personal Data by you to AERODYNE is voluntary in nature, consent is required from you to facilitate Processing of Personal Data by AERODYNE for various Purposes as outlined in Section 5.

If you do not provide your Personal Data, where essential, or do not consent to the Processing of your Personal Data by AERODYNE, AERODYNE may not be able to communicate with you, process your application with AERODYNE’s services.

When you provide your personal information to AERODYNE, you agree to AERODYNE in handling your Personal Data as outlined in this notification. Additionally, you verify that all the information you have provided is accurate, complete, and not misleading or outdated. You commit to promptly informing AERODYNE of any changes to your personal details.

3.0 COLLECTION OF PERSONAL DATA

AERODYNE may obtain your Personal Data from the following sources: - 

 (a) Directly from you via the submission of Application Form (and/or submission by your authorized representatives);  

 (b) Agreements, contracts, booking forms, and/or any other documents that you shall have signed and/or provided to us which we have access thereto;  

 (c) Our holding. Subsidiary and/or related/affiliates companies and/or contractors or business partners having records of your Personal Data;  

 (d) Our legal, auditors, accountants, consultants, bankers, and/or any other parties in which we have dealings with; 

(e) Other legal means and/or searches from the relevant governing authorities/bodies/agencies and/or credit reporting agencies and/or bodies/ agencies which are legally allowed to collect, use and/or process your Personal Data.  

(f) Further, AERODYNE may also collect your Personal Data from variety of sources, including without limitation at any events, conferences, seminars, or talks, organised, or sponsored by AERODYNE and/or from the cookies used and/or Personal Data that you willingly provided on AERODYNE’s website.

Sensitive Personal Data

The Personal Data that AERODYNE collects, and process may include what is defined as “sensitive personal data” under the PDPA and these includes, but not limited to, your physical or mental health condition, political opinions, racial information, religious beliefs, or other beliefs of a similar nature, commission or alleged commission of any offence. 

AERODYNE shall be treated carefully the sensitive information and will only use it for specific purposes and disclosed only when strictly necessary.

4.0 OBLIGATORY PERSONAL INFORMATION

All information requested for in the relevant forms is obligatory to be provided by you unless stated otherwise. This is to enable AERODYNE to process your application/request and offer our services to you.  

Should you fail to provide the said information, AERODYNE may be unable to process your request and/or provide you with the relevant services.  

5.0 PURPOSES OF PROCESSING

During the course of AERODYNE’s business and activities, AERODYNE may not collect your Personal Data unless: - 

● You (or your authorized representative) have been notified of the Purposes for which the data is collected, and 

● You (or your authorized representative) have provided written consent to the collection and usage of your Personal Data for the Purposes.  


The Purpose for which Personal Data is collected and further processed includes, but not restricted to the following: - 

(a) Administrative and internal record-keeping purposes such as processing, confirming, fulfilling our obligations and completing transactions with you; 

(b) To submit relevant applications to authorities in pursuant to courses purchased by you such as to apply for the relevant drone flying permit with the Civil Aviation Authority Malaysia;  

(c) To register relevant certifications with Civil Aviation Authority Malaysia upon your successful completion of relevant courses purchased by you;  

(d) Providing and delivering AERODYNE’s offers, products, and services to you;  

(e) Verifying your identity and responding to, handling, and processing queries, requests, applications, complaints, and feedback from you;   

(f) Managing your relationship with AERODYNE;  

(g) Tax, accounting, auditing, and billing purposes for AERODYNE’s operations;  

(h) Investigation of claims and inquiries, refunds, safety, security, testing, research, analysis, and product development for AERODYNE;  

(i) Procuring professional legal, compliance, technical, business, and accounting advice for AERODYNE;  

(j) Mergers, acquisitions, joint ventures, sale of company assets, consolidation, restricting, financing, business asset transactions, or acquisition of all or part of AERODYNE’s business by another company;   

(k) Providing, monitoring, and improving customer support, customer relations, customers surveys, and servicing you by identifying your requirements and preferences for AERODYNE; 

(l) Complying with any applicable laws, regulations, codes of practice, guidelines or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;  

(m) Any other purposes for which you have provided the information;  

(n) To operate AERODYNE premises in a manner which is physically safe, secure and befitting of health and safety requirements;  

(o) For AERODYNE’s internal records management and statistical analysis;   

(p) Internal record keeping throughout your training program with AERODYNE; 

(q)  For client’s relationship management and conducting internal conflict and background checks in accordance with legal or regulatory obligations or risk management procedure that may be required by law or that may have been put in place by AERODYNE;   

(r) For the proper performance of AERODYNE’s contractual obligations to you (which may include transfer of certain Personal Data for cross-border engagements); and  

(s) Any other purposes required to operate and maintain AERODYNE business as set out in AERODYNE’s Privacy Policy.  

(collectively referred to as “Purposes”). 

Other Purposes

AERODYNE may also use and process your Personal Data for other purposes such as: 

 (a) To send you materials such as newsletters, articles, write-ups as well as other updates;  

(b) To distribute information or details of events, seminars, conferences and talks which may be of interest to you.  

By way of email or ordinary correspondence.  

If you do not consent to AERODYNE in processing your Personal Data for the purposes listed above, please notify AERODYNE using the contact details stated below.

6.0 TRANSFER OF PERSONAL DATA & DISCLOSURE TO THIRD PARTIES

As AERODYNE’s information technology storage facilities and servers may be located in other jurisdictions, your Personal Data may be transferred to, stored, used, and Processed in a jurisdiction other than Malaysia, for the purposes as described above. You understand and consent to such transfer of your Personal Data.


AERODYNE may engage other companies, service providers or individuals to perform functions on AERODYNE’s behalf, and consequently may provide access or disclose to your Personal Data to the third parties such as (not exhaustive) other business partners, industry associations, sponsors, service providers, AERODYNE’s professional advisers, other individuals performing AERODYNE’s functions on its behalf, regulatory and governmental authorities in order to comply with statutory and government requirements; specified parties that AERODYNE were ordered or directed to disclose pursuant to an order of court, tribunal or authority, whether governmental or quasi-governmental with jurisdiction over AERODYNE; persons whose vital interests (e.g. life, death, health, and/or security) may be jeopardised by virtue of close contact and/or proximity with you; and/or other third parties authorised by yourself.


Please note that these foreign entities may be established in countries that might not offer the same level of data protection that is equivalent to that is offered in Malaysia under the laws of Malaysia. You hereby expressly consent to AERODYNE transferring your Personal Data outside of Malaysia for such purposes. We shall endeavour to ensure that reasonable steps are taken to procure that all such third parties outside of Malaysia shall not use your Personal Data other than for that part of Purposes and to adequately protect the confidentiality and privacy of your Personal Data.


This Privacy Notice only applies to the Processing of Personal Data by AERODYNE for the purposes specified in this Privacy Notice in Section 5. It does not cover the privacy policies and conduct of any third parties, even if such third parties are related to AERODYNE.

7.0 ACCESS & CORRECTION REQUESTS AND INQUIRIES

The provision of your Personal Data is voluntary. Subject to any exceptions under applicable laws, you have the right at any time hereafter to request for (a) access to your Personal Data and a copy of your Personal Data, (b) correction of your Personal Data, (c) to limit the Processing of your Personal Data, (d) withdraw your consent to the Processing of your Personal Data, and (e) seek further information by contacting the following: -

AERODYNE has the right to refuse your requests to access and/or make any correction to your Personal Data for the reasons permitted under the law, such as where the expense of providing access to you is disproportionate to the risks to your privacy and/or when AERODYNE is unable to confirm your identity, or the accuracy of the corrected Personal Data provided.  

Please note that withdrawing your consent does not affect AERODYNE’s right to continue to collect, use and disclose your Personal Data where such collection, use and disclosure without consent is permitted or required under applicable laws.  

8.0 STORAGE & RETENTION OF PERSONAL DATA

AEROYNE will only retain Personal Data provided by you (or your authorized representative) as long as it is necessary to fulfil the purposes for which it was collected, or as required or permitted by applicable laws. 

AERODYNE will cease to retain your Personal Data or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention is no longer necessary for the Purposes for which the Personal Data was collected and is no longer for legal or business purposes.  

9.0 YOUR OBLIGATIONS IN RELATION TO YOUR PERSONAL DATA

You shall immediately inform AERODYNE of any changes to the Personal Data which you have provided to AERODYNE to such extent necessary in order to enable AERODYNE to remain in compliance with the applicable law. AERODYNE will use its reasonable efforts but shall not obligate to procure updates from you on regular periodic basis.

For the avoidance of doubt, you agree that AERODYNE shall not be liable for any costs, damages, fines, losses, liabilities and/or penalties that you and/or third parties (including but not limited to an individual or competent authority) have incurred or suffered as a result, whether directly or indirectly, from the breach of any terms, conditions, representations, warranties, and/or obligations detailed in this Privacy Notice by yourself and/or by anyone acting on your behalf, instructions, and/or of such confirmation.

You further agree to indemnify and hold AERODYNE harmless against any actions, claims and/or demands brought against AERODYNE by any third parties (including but not limited to an individual or competent authority) and any costs, damages, fines, losses, liabilities and/or penalties (including but not limited to legal costs) which AERODYNE may incur or suffer, as a result, whether directly, or indirectly, from the breach of any terms, conditions, representations, warranties, and/or obligations detailed in this Privacy Notice by yourself and/or by anyone acting on your behalf, instructions, particularly where AERODYNE was provided with false, incomplete or inaccurate Personal Data, failure to update AERODYNE of any changes to Personal Data, and/or the necessary consent and authorisation was not obtained or maintained from relevant third parties. Notwithstanding anything contained herein, the liability of the AERODYNE (if any) shall be limited to the fullest extent permitted by the applicable law. In no event shall AERODYNE be liable for any consequential, incidental, indirect, punitive or special damages or loss of profits, loss of anticipated profits, data, business or goodwill, regardless of whether such liability (if any) is based on breach of contract, tort, strict liability, or otherwise and even if AERODYNE has been informed or advised of the possibility thereof.

10.0 SECURITY

AERODYNE cannot ensure or warrant the security of any information you transmit to AERODYNE, and you do so at your own risk. AERODYNE does not warrant such information may not be accessed, altered, collected, copies, destroyed, disposed of, disclosed, or modified by breach of any of AERODYNE’s physical, technical or managerial safeguards.

This Privacy Notice is governed by and shall be construed in accordance with the laws of Malaysia. You hereby submit to the non-exclusive jurisdiction of the Malaysian Courts.

DEFINITIONS

For the purposes of this Privacy Notice: - 

“Personal Data” means information about you which you have provided to AERODYNE such as your name, address, telephone number, NRIC, e-mail address, your personal preferences, particulars of your spouse or family members and bank account information and any other information which may identify you, your spouse or family members that has been or may be collected, stored, used and processed by AERODYNE from time to time.  

“Process”, “Processed” or “Processing” all means the collection, usage, recording, storing, retention, disclosure, and other operation or set of operations relating to Personal Data as described in the PDPA.
